Permanent Residency (VIPER) – Birth of a Child in Brazil

Foreigners planning to obtain temporary residency in Brazil may apply under family reunification. If you are married to a Brazilian national residing in Brazil or even a foreigner holding a residence permit (temporary or permanent) in Brazil (RNM), you can apply for family reunification.  Family reunification is also applicable to children or grandchildren of a Brazilian national or a foreign resident permit holder, as well as to parents or grandparents of such individuals. Additionally, siblings under 18 years old of a Brazilian national or a foreign resident permit holder may apply. Siblings over 18 years old may also be eligible if they are students under 24 years of age or are economically dependent on the sponsoring family member.

Eligibility Requirements:

  • Must be a parent of a Brazilian-born child (child automatically receives Brazilian citizenship)
  • Child’s official Brazilian birth certificate
  • Proof of parental responsibility (legal guardianship, custody, or recognized parentage)
  • Sworn translations of all foreign parental documents

  • CPF registration (Brazilian taxpayer number)

  • Proof of parental responsibility (legal custody, parental declaration, or court document if applicable)
  • Police clearance certificate (apostilled & translated)
  • Sworn translations of all foreign documents in Brazil

Permanent Residency via Brazilian Child – Citizenship Possible After 1 Year

Provides VIPER permanent residency through parenthood of a Brazilian-born child. Visa remains valid indefinitely as long as parental responsibility is maintained.
The Brazil citizenship is possible after 1 year of approved residency for the foreign parent.

All-Inclusive Legal Assistance: From Documentation to Hospital Discharge

Initially, legal support involves: Analysis of the documents from (translated and registered); legal representation before the Brazilian Federal Police and presentation of the client’s documents; preparation of the process, filing with the competent bodies, entry of the process with the competent body or bodies, legal representation (to prepare the Brazilian documents – RNE and/or CPF), interlocutory follow-up, scheduling, contact with the Brazilian government. Interaction with the perinatal maternity hospital to schedule hospitalization. Follow-up of the process until the visa is obtained and the patient is discharged from hospital.

We suggest that you arrive in Brazil 2 months in advance, as there may be a need for some care and examinations before the birth.* 
The cost of renting houses is at the client’s expense (please search for property on Airbnb, Barra da Tijuca neighborhood – Rio de Janeiro. This is the same neighborhood as the maternity hospital.

Note that, in addition to choosing where to have the baby and looking for a place to stay, knowing that your interest involves citizenship, we need to organize all the documentary issues (parents) for the process that must begin as soon as possible (analysis of the parents’ documents, eligibility for citizenship, legal representation with the entities responsible for immigration in Brazil, among others…).
